Violated by Yahoo! Games while I was sleeping (updated 2011-01-29)

Thursday night (26 of jan 2012) I got a mejl, I wrote about it yesterday, in a blogpost. Yesterdays blogpost is mostly about the condition Yahoo wanted to use my pictures (about 800 pic’s) of Stormtrooper.  In short I thought the conditions to say the least were intriguing, and not in my advantage. It said:

(1) You retain ownership of your Photos, however, you grant to Yahoo! Inc. a non-exclusive, worldwide, royalty-free license (but not the obligation) to sublicense, use, copy, modify, translate and/or adapt, distribute, publicly perform, publicly display by any means and in any media, your Photos on Yahoo! News and local Yahoo! News sites in other countries.

(2) You represent and warrant that your Photo is an original work taken by you and you own or have the necessary rights to all copyrights or other proprietary rights in your Photos. You also represent that you are over 18 years old.

(3) To the extent that your Photos are displayed on Yahoo! Inc.’s pages, Yahoo! Inc. will provide a link from your Photos to the gallery and associate an alt tag displaying your Flickr screen name in connection with the Photos.

And all Yahoo! Games wanted was for me to reply with a mejl telling them that I approve with capital letters. I choose to not send an reply, because I DON’T AGREE!!! . And I thought that the my lack of my reply would mean that nothing would happen, I believed that Yahoo would respect my Intellectual rights, the Creative Commons license I use on my work.  Mostly I thought they would do that because I’ve read on flickr that:

Yahoo! respects the intellectual property of others, and we ask our users to do the same.

But I was wrong! I share my photos on flickr, with a Creative Commons licensen, an non commercial license. I mostly use BY, NC, SA as my default license. I use Creative Commons because I believe in Creative Commons values.

And I share my work, with others to give others the possibility use my work, but I have drawn a line for Commercial use, then I want to be asked. And Yahoo! Games seamed to have understood that, it seamed that way when they asked for my permission to use my pictures. I didn’t reply. I didn’t give them the rights to use my pictures, to share them, but they did it anyway.

I got raped on my rights, by Yahoo! Games and it happened while I was sleeping.

Update: After I had written this post I mailed Yahoo, and told them that I WILL NOT, WILL NOT accept there terms, and that I wanted them to follow the Creative Commons license I had choosen for my work, I also asked Yahoo to tell there community that I share my work under a creative commons license.

Last night I got a reply that they would take down the pictures, with following message:

Yahoo! Games seams to have missed the part of telling there community that they hadn’t followed the conditions under which I share my work Creative Commons, Attribution, non commercial, Share alike.

Flattering spam or what…

Just before i went to bed I got an e-mail adressed to Jeannine (my name is Kristina) from a Content producer at Yahoo! Games. According to the mail he found my images on flickr and wants permission to possibly use them on the Yahoo.com website and in a gallery at Yahoo! games. This is a part of the e-mail (I bolded some parts):

We believe that your participation in this would be a good opportunity for promoting your photography.

To allow us to include your photos as stated above, we need your consent.

 

Therefore, if you agree with the below terms in connection with Yahoo! Inc.’s use of your photos, please reply to this email with the term AGREE in caps.

 

Terms of License Grant:

 

(1) You retain ownership of your Photos, however, you grant to Yahoo! Inc. a non-exclusive, worldwide, royalty-free license (but not the obligation) to sublicense, use, copy, modify, translate and/or adapt, distribute, publicly perform, publicly display by any means and in any media, your Photos on Yahoo! News and local Yahoo! News sites in other countries.

The intriguing about the mail is several things. The way I am supposted to agree is to reply through an e-mail, is that legally binding? How do they know it´s me replying and not someone else? Then there´s the conditions. They write that they want to use my Stormtrooper-pictures in my photostream, which means they are asking me to give them the right to use any of over 800 images.

And what does this mean:

(1) You retain ownership of your Photos, however, you grant to Yahoo! Inc. a non-exclusive, worldwide, royalty-free license (but not the obligation) to sublicense, use, copy, modify, translate and/or adapt, distribute, publicly perform, publicly display by any means and in any media, your Photos on Yahoo! News and local Yahoo! News sites in other countries.

Read it slowly, I will retain ownership, but I am supposed to give Yahoo a non-exclusive, worldwide, royalty-free license, to sublicense, use, copy, modify, translate and/or adapt, distribute, publicly perform, publicly display by any means and in any media, yadayadayada. And all I possibly is offered is a gallery on their website.

Flattered, Yes but come on I feel like David against Goliath…

 

Digitala läromedel – några korta reflektioner kring en föreläsning

Jag fick frågan om jag kunde tänka mig att prata lite kort om digitala läromedel. Hur ser jag på digitala läromedel. Min presentation kom att belysa flera aspekter på digitala läromedel.

Jag startade presentationen med att prata om ”varumärken” om inlåsning kring vilken sorts ”apparat” eller ”maskin” som skolan ska ha, diskussionen kring ”en till en”, ”varsin”, ”en till alla” eller vad satsningarna kring att dela ut datorer kallas. Det digitala läromedel skapas inte per automatik för att elever och lärare har en Apple eller en PC. Sedan pratade jag om att infrastrukturen, att det fungerar, att det finns ett trådlöst nät som fungerar är ett villkor. Men jag vill trycka på att det är inte maskinen i sig som skapar läromedlet, eller förändrar lärandet.

Sedan gick jag över till en diskussion kring vilka behov som finns, skolan som en plats med många dimensioner, traditioner och nyheter, lärare befinner sig på olika platser, har olika behov, alla lektioner kan inte vara innovativa och nytänkande. Ibland behövs fylleriövningar också, sedan är de digitala verktygen/läromedlen ett bland många, kanske inte det enda.

Sedan stannade jag upp en stund kring kunskapssyn, och hur vi ser på förmedlingen av kunskap, vilka källor använder vi, är kunskap beständigt, kan vi lära andra, eller bara lära oss själva? Det är centralt att fundera kring vilken kunskapssyn som ett digitalt läromedel sprider, är uppbyggt kring. Sedan kan fundera på varför – ska läromedlet vara digitalt och sedan hur …

Vad kan digitala lärresurser ge som inte analoga kan? Min fasta inställning är att digital kompetens kan du inte uppnå om du inte använder, funderar, tar del, av den digitala vardagen, använder digitala verktyg, blir är digital. Inget analogt läromedel kan ge elever digital kompetens, kanske kan vi aningar om den digitala vardagen men det är lite som att torrsimma, och tro att man vet hur det är att simma på ett öppet hav.

Sedan tog jag fasta på andra delar som digitala medier/läromedel bör kunna ge eleverna, vara bra på, som t.ex färdighetsträning, diskuterade några aspekter kring spel och spelifierandet av lärandet. För att sedan gå över och prata om de som digitala läromedel bör ta möjligheten att vara, som låta användarna vara medskapande, internets autenticitet, möjligheterna till att dela, bygga vidare, kunskapa gemensamt, multimedialt och att alla läromedel bör leva som de lär.
